AGREEMENT OF SALE www.dragonflypets.com 6286 Hoover Ave Dayton Ohio 45427 phone 937-854-5832 15 minutes from downtown Dayton Ohio This puppy at time of sale is a healthy, happy puppy of sound temperament. Your puppy has had an examination by my Veterinarian and is guaranteed to be in good, clean state of health on departure from Dragonflypets. You are advised to have your Veterinarian examine your new puppy within 72 hours of departure. This puppy is being sold on a spay, neuter contract unless agreed upon in writing by Dragonflypets. The seller further guarantees this puppy to be free from any serious genetic defects for two(2) years from date of purchase, which impairs life, good health, and full function as a pet. If purchaser neglects to spay or neuter puppy at or around six (6) months of age, the health guarantee is null and void. If breeding rights, are agreed upon, contract shall be reactivated. If such a genetic defect should occur, and is diagnosed in writing by a qualified Veterinarian, seller has the right to have the dog examined by a Veterinarian of her choice. You may choose to keep your dog or let us take care and custody of the dog and take a new puppy. In the event a genetic defect occurs rendering the dog non functioning as a pet but you decide to keep it anyway we will pay for vet expenses up to the price you paid for the dog less the deposit limited to the dog day it becomes 2 years old. All Veterinary cost after departure no matter what reason and including the 72 hour period are the responsibility of the buyer. See above for exception. I/We agree to take proper safeguards for the care and safety of the puppy sold, including, but not limited to necessary food, veterinary care and general care to maintain good and proper health. I/We agree to contact the seller should I/We be unable to keep the puppy so that the seller can either take the puppy back or assist in finding another suitable home. At no time shall this puppy be sold to a pet shop, dealer or agent of either. It is understood and agreed to by the parties to this agreement and the purchase and sale of the said puppy shall fall under the jurisdiction of the laws of Counties of Montgomery or Miami, state of Ohio and that any matters with respect to this Agreement, shall be dealt with as per laws governing these locations. It is further understood that any circumstances/situations/disputes arising which are not covered within this Agreement, shall be remedied at the discretioon of the seller and the seller's decision shall be final and binding. By signing this Agreement of Sale the purchaser acknowledges having read this Agreement in its entirety and agrees to all terms and conditions within this Agreement. If your mini goes over 45lbs before the age of 14 months, and deemed by Vet check, not to be obese, a refund will be given to make up the difference between price for standard and price for mini. Medium doodles priced about the same as standards should be around 50 lbs but not guaranteed to stay under 50 lbs. Remainder is due in your puppies 4th week. Yes we occasionally take payments. If you can not do this I will snail mail you 2 copies along with the puppy desires form. I must have these 2 forms for records of your puppy. WHAT IS INCLUDED WITH YOU PUPPY AND OTHER FAQ INFO *Health Checkup and shot records *2 year genetic health warranty against life threatening problems or another puppy will be given to you. You are not required to give up the dog you already love unless you want to, in which case we will keep or place it. Shipping of return dog is at your expense. *Contract to be signed to spay or neuter by 6 months or warranty is null and void, the act of breeding and producing a litter puts your dog at risk as well as dragonflypets. I have had someone demand their money back because their bitch only had 3 puppies. I feel it is necessary to explain why this is required as I have had people irate about this requirement. Please see next sentence if you wish to breed. *Potential breeders sometimes sold at private treaty in which case genetic warrenty remains active. *Extra costs include Shipping and crate at new owners expense, approximately $200. *Deposit of $200.00 is required to put you on the puppy list, then remainder at 4 weeks of age. It is non-refundable We realize things do happen, with open communication we can make exceptions. *Your puppy must be picked up within 7 days of its 8th week or we must charge 5.00 per day plus any expenses 1st day of its 9th week). Puppies traveling by air are exempted from these charges if weather is involved. *Yes, we consider flying safe, we make arrangements for the flight of your pet. * We reserve the right to refund a deposit if we do not feel these special dogs will get loving permanent homes. Do not waste our time if you just want the new "trendy, designer dog" to impress friends at the hairdressers and country club. Yes, this sounds mean, we have been burned and are tired of it. * Deciding to get a new carpet before your new puppy comes home is not considered a reason to get your deposit back and decline the puppy. It takes us longer to find new homes for older puppies, please be considerate of us and caring for our time and expenses involved. I used to say I would never sound mean spirited on my web site like so many other breeders but after breeding dogs for 5 years I understand what they have gone thru to sound so nasty. *We board dogs purchased from us. Fees are $5.00 a day *Please understand this is a family business and sometimes time with family comes first. We get 10 to 20 or more emails a day and several phone calls as well. It make take a day or 2 to get caught up sometimes but we will get back. |
